Man claims he was beaten by discount store clerk

DETROIT (WJBK) - Labor day weekend, demonstrators gathered to protest outside the Dollar Center on Livernois. Lacy Winter of Detroit says he was attacked by a clerk there Aug. 7th.

"I got a fractured jaw, neck and back," he said.

What began as a routine shopping trip ended with him being assaulted after misplacing his cell phone and asking a clerk to pull up surveillance video to help him find it.

"He said he didn't have my phone," Wheeler said. "I said I wasn't saying he had my phone and then he said 'what the (expletive) you want me to do.'"

After the clerk allegedly swore at Lacey and he told him he didn't have to talk like that, Lacey says the man confronted him.

He put his hand on me and slammed me into the racks, put me in a (mixed martial arts) arm bar, then put me in a choke hold," Lacey said.

Police say medics took Lacey  to the hospital in temporary serious condition where he was admitted for five and a half days.

The clerk who allegedly attacked him has not been arrested.

According to Detroit Police, the suspect claims Lacey started the fight.

Investigators however are not seeking charges against him but are working on a warrant for the man Lacey says attacked him.

Fox spoke with two employees of the store who said nothing happened on Aug. 7. They referred to a manager who said that the security cameras were not working that day.
