Family: County won't pay medical bills for baby 'Bou Bou'

HABERSHAM COUNTY, Ga. - A toddler hit by a SWAT team's flash-bang grenade is doing much better, but his family says they have been stuck with mounting medical bills.

The medical bills piling up at the Phonesavanh home now exceed $800,000. The family can't pay them and the Habersham County government won't pay them.
 
"That is a very big problem," said Alecia Phonesavanh. "And my family and I want to make it clear to the county and everybody else
that we will not give up this fight."
 
Phonesavanh's son, Bounkham, was 19-months old in May when drug task force members threw a flash bang into his crib, severely injuring him. The Phonesavanh family was staying with friends in the Habersham County home, not aware that the home was the target of a drug investigation. Officers had a "no-knock" warrant and when they couldn't get through the front door, they threw the flash bang through an opening. It inadvertently landed next to Bounkham.

"He is still having nightmares where he wakes up screaming, every night, quite often throughout the night," said his mother.
 
Days after the incident, Habersham County Sheriff Joey Terrell told FOX 5 the county would pay for Bounkham's hospital bills.

"They had made it publicly known that they were going to take care of any medical expenses that our son had acquired," said Phonesavanh.
 
But the county recently told the family, that would not be the case. The Habersham County Board of Commissioners decided it had no legal authority to pay the bills. County Attorney, Donnie Hunt told FOX 5's Chris Shaw, Sheriff Terrell made the comments about paying in a "moment of high emotion."
 
Hunt says he expects the family to file a lawsuit against the county to get that money.
