Grand Jury Finds No Excessive Force Used Against Teen

PHILADELPHIA -

Philadelphia's District Attorney released the grand jury findings into a case of alleged police misconduct.

A teenager claimed he was illegally stopped and assaulted by an officer.

Family members said at the time he was injured so severely, that the attack may have left him sterile.

He was on his way to a basketball game with teammates.

"I was just in a lot of pain," said 16-year-old-Darrin Manning.

Manning and his mother Ikea Cooney told anyone who would listen back in January how the straight a student had been assaulted by Philadelphia Police.

"I had the cuffs on and she patted me down and that's when I felt her grab it and squeeze and then she pulled it down," said Manning.

Manning claimed a female officer grabbed his genitals during a police stop near 15th and Girard after Manning and some basketball teammates exited the subway on their way to a game. Police say Manning assaulted an officer, and officers say they never assaulted the teenager. Thursday the District Attorney Seth Williams weighed in after a grand jury investigation.

"The evidence is very clear there was no excessive force," said Williams.

"His version of events was not corroborated by any witnesses, any physical evidence and medical evidence," said Assistant District Attorney Mark Costanzo.

This was stop and frisk at its highest as supporters rallied around Manning and his mother. There was some talk of rallies in support of the teenager and against the police department's stop and frisk policy. Through it all, police maintained their officers did nothing wrong.

"The police did show considerable restraint. There was no bruising, they didn't like throw student number one on the ground, up against any cars, no weapons were used," said Williams.

Fox 29's Dave Schratwieser tried to get a response from the lawyer for the teen and his mom, there was no response. Commissioner Ramsey is out of town on business. He's expected to respond when he returns. Manning is still facing aggravated assault and resisting arrest charges.
