Sleeping Yankees fan sues ESPN TV announcers

Posted: Updated:
NEW YORK (FOX NEWS) - A New York Yankees fan has filed a $10 million lawsuit against two ESPN announcers claiming they mocked him when he was caught on national television sleeping in his seat during a game.

Andrew Robert Rector admits in court documents he "napped" during a game against the Boston Red Sox at Yankee Stadium on April 13, but says commentators Dan Shulman and John Kruk unleashed an "avalanche of disparaging words" against him.

The typo-ridden lawsuit says the announcers made “false statements” about Rector and suggested that he “is a fatty cow that need two seats at all time and represent symbol of failure,” according to the New York Post.

It adds that Rector was described to be “a confused individual that neither understands nor knows anything about history and the meaning of rivalry between Red Sox and New York Yankee.”

Rector, 26, says he suffered "substantial injury" to his "character and reputation" and "mental anguish, loss of future income and loss of earning capacity."

The lawsuit, filed in Bronx Supreme Court Thursday, also names ESPN, Major League Baseball and the Yankees as defendants. They didn't immediately respond to requests for comment.

In a YouTube video posted by MLB, Shulman and Kruk seemed surprised that Rector was snoozing during the game’s fourth inning.

“Did he sleep through the [Carlos] Beltran homer? I mean 45,000 people stand up and cheer, and he sleeps through?” Shulman asked.

Rector’s lawyer, Valentine Okwara, told the New York Post that “We’ll settle this in court.”

His mom, Hana, said Rector is out of town and cannot be reached.

She defended the lawsuit, saying, “It should send the message that idiots need to stay out of people’s business and not make fun of people who are harmless.”
