Widow of dead sanitation worker sues City Hall

The widow of a sanitation worker who died in a crash near Cleveland Avenue is suing Atlanta City Hall.

Louise Simmons, is also suing the Estate of Melvin Callahan, the man responsible for the crash.

An internal investigation revealed Callahan had been drinking at the time of the accident, he swerved to over correct, flipping the dump truck on it's side. Simmons husband, Derryl, was ejected from the truck. He died on the scene.

Investigators found an open vodka bottle at the scene of the accident. Callahan was charged with Homicide by Vehicle in the first degree, DUI, Reckless Driving, and Failure to Maintain Lane.

"I lost my husband, I lost my best friend and I haven't gotten any answers from the City of Atlanta about what happened to my husband. Why this was allowed to occur," Simmons said in a Tuesday afternoon press conference.

Simmons is suing for unspecified damages. She's being represented by The Davis Bozeman Firm.

The City of Atlanta does not comment on impending litigation.
