HIT IT OR TICKET? Rosemount driver cited for avoiding pothole

Just last week, a Minneapolis driver was sent to the hospital after he was hit in the face by his airbags when he drove over a pothole. Now, a Rosemount driver is facing a ticket for trying to avoid a similar fate.

"It shakes your vehicle so severely that you feel like you're going over a landmine," Allen Moe told Fox 9 News. "It feels like it's about to tear my truck apart."

For more than two years, Moe has been going out of his way to avoid a string of potholes that rattled his truck. Now, his nerves are rattled because he was cited for failing to stay in his lane.

"I swerved just to get around the potholes and then I came back into my lane," Moe recalled. "After I went through the stop light, he stopped me."

For many motorists, the pothole moonscapes present a no-win situation. Hitting a pothole could damage a car or blow a tire, but swerving to avoid it could wreck your record. Either way, it seems there's something to pay.

As for Moe, he was driving his girls to dance class, and he said at one point, the officer even suggested he may have been texting; however, the father of two insisted that the swerving was a deliberate attempt to save his suspension.

"We all do it in this community," Moe protested. "We have to -- to preserve our own vehicles -- and he didn't like that."

Car after car, Fox 9 News cameras caught numerous drivers veering to avoid the potholes. Some went to the left; others opted to go to the right -- and now, the mayor of Rosemount is weighing in.

"That's what I do when I drive down this street," Mayor Bill Droste said."It deteriorated so quickly here this winter that you have to drive around potholes."

The pothole problem was caused by the type of overlay done a few years ago. In fact, the section of Shannon Parkway where Moe was cited is scheduled to be resurfaced in June. In the meantime, Moe plans to fight the ticket -- not only because of the $128 fine, but purely out of principle.

"He said, 'I have you on video,' and I said, 'Good! I'm so glad you do because it will show -- it will show you, it will show anyone who looks at it -- that I was clearly moving my way through this pothole region,'" Moe said.
