NST said continues to pursue this action in Shelby County Circuit Court, which they maintain is the proper forum for this lawsuit since it involves claims of negligence and reckless behavior and because the suit is for unliquidated damages.

On Friday March 28, 2014, a hearing was held on NST's Motion to Intervene for the purpose of clarification in Davidson County Chancery Court. Pursuant to the court's instructions, NST will continue to move forward with its lawsuit by engaging in discovery and by taking depositions in Shelby County without interfering with the duties of the state-appointed Special Deputy Receiver, who has taken over operations of the cemetery.

Initially two plaintiffs filed a $100 million lawsuit against Galilee Memorial Gardens Cemetery, accused of desecrating dozens of graves. Two funeral homes in Memphis were also named in the suit.

Memphis attorney Howard Manis and partners of Manis Law Firm have filed a class action multi-layered lawsuit on behalf of two plaintiffs.

MORE: Bond revoked for Bartlett cemetery owner

Galilee Memorial Gardens was shut down by the State of Tennessee in January after accusations of the dead buried on top of one another, crushed caskets, bodies buried adjacent to the cemetery property, and theft. Manis said his firm blames the cemetery, but also two Memphis funeral homes, N.J. Ford and Sons and M. J. Edwards.

Jemar Lambert is being held without bond, accused of burying bodies on someone else's property and stacking caskets on top of each other when he ran out of space.

In February, former U.S. Attorney and Memphis lawyer David Kustoff was placed in charge of operations at Galilee Memorial Cemetery.
