No felony charges in St. Louis park retention pond crash

ST. LOUIS PARK, Minn. (KMSP) -

No felony charges will be filed against the driver of a car that plunged into a freezing retention pond in St. Louis Park last November.

Investigation indicated 23-year-old Marion Noel Guerrido appeared to have overcorrected and spun out on the ramp from Highway 7 to Highway 100. The accident reconstruction, tests and interviews with Guerrido indicate she was not speeding, did not have drugs or alcohol in her system and had not been on her cell phone.

Two children were killed as a result of the accident, Alarious Guerrido, 7, and Zenavia Rennie, 5. The other children in the car were 1, 5 and 6 years old. All are from Brooklyn Center.

Guerrido tried to rescue the children upon crashing, police said, but it took emergency crews to pull them out. The first child was pulled out of the car after 25 minutes, the last after 45 minutes, Minnesota State Patrol confirmed. The pond was near freezing, police said.

Although it was determined the Guerrido only had a learner's permit at the time, Hennepin County officials say harsh charges don't apply in the case -- but the say it isn't because they feel like she has suffered enough. In fact, Guerrido still could face a number of lesser charges.
