MEMPHIS, Tenn. (FOX13) -

Last week's frigid weather brought down a lot of tree limbs all across Shelby County. So the question is, if it's your tree on your property, but its branches fall and damage your neighbor's home, who is responsible?

There is no definitive answer for every situation says Stacey Collins, President of Collins Financial Group and a Nationwide Insurance Agent.

"The property owner who owns the tree and causes damages, if the tree is deemed healthy, then the other party would be responsible for damages, "said Collins.

Collins says it depends on your specific policy, but it also depends on the health of the tree which should be investigated.

"If the insurance company deems the tree not healthy or dead, then of course I would be responsible, "said Collins.

Meaning homeowners who are found to have dead trees whose branches cause damage to another property could be held responsible. But not if the tree was healthy, and act of god like a weather incident brought down the branches.

Lavern Branch has been dealing with branch problems at her Raleigh home for over a month now. A neighbor's branch came crashing into her attic and last week's storms brought even more damage. Act of god or not, she says her neighbor is responsible to pay.

 "Well if they are going to deem it an act of god, that's why we have insurance to take care of things like this, if they had cut or trimmed their trees like I had been asking them, none of this would have happened," said Branch.
