GERMANTOWN, Tenn. (FOX13) -

In a 3-0 vote with two board members absent, Germantown Municipal Schools Friday evening decided to rescind tuition for non-residents.

The board voted for the non-resident tuition Monday.

GMS board member Lisa Parker said the main reason the tuition was rescinded is "that it put GMSD and all the other municipalities in jeopardy because Judge Hardy Mays has not signed off on the final documents."

The school board voted Monday to charge a small fee for non-residents to attend the five schools -- $200 per child, per year, and a family cap of $500 a year.

The fee would have affected 1,000 Collierville families whose children attend Germantown-controlled Houston High, Houston Middle and Dogwood Elementary.

State Rep. Curry Todd (R-Collierville) questioned the legality of GMS' resolution to charge tuition for non-residents next school year.

The Germantown Schools decision has drawn the scrutiny of Rep. Todd, who has asserted charging tuition was not previously agreed to in  setting up legislation that paved the way for municipal school districts. Some critics feel the move may push Judge Mays to delay a final decision on the merger concerning possible racial disparities in the muni-systems.
