An internal memo obtained by FOX13 News concerning a December 2012 fatal crash involving former Shelby County Elections Commission Chairman Bill Giannini in December 2012 showed Tennessee Public Safety Commissioner Bill Gibbons, was kept up to date about the investigation from the very beginning.

Commissioner Gibbons, a former Shelby County District Attorney, was asked why he had a special interest in this one fatal car crash out of hundreds that happen in the State of Tennessee.

"From time to time I would the check the status of it for obvious reasons," Gibbons said. "It was a high profile case and the media was interested."

More than 500 fatal car crashes were recorded in Tennessee in 2012 and Commissioner Gibbons wanted updates about this one. The December 2012 fatal accident involving Giannini, now an assistant commissioner with the Tennessee Department of Commerce and Insurance.

"I am going to inquire about the status of that case," Gibbons said. "where are we, how much longer is this going to take. That's part of my job."

An email obtained by FOX13 News from one of the supervising highway troopers said a trooper being informed that Giannini will not be charged with a serious crime for causing an accident that killed 8-year-old Quindarious McGhay.

He writes, "I will forward this to the command staff and to the commissioner. They have kept up with this from beginning."

"I can tell you that I have never even looked at the investigative file on that case," Gibbons said.

Greg Coy: "It gives the appearance that you may have been involved?"
Gibbons: "No, not at all. I can tell you that I have never even looked at the investigative file on that case."

Nevertheless, this e-mail clearly said Commissioner Gibbons was being kept in the loop.

Greg Coy: "Why does the public then believe his connections in Shelby county resulted in him not facing serious consequence?"
Gibbons: "Well, first of all I have no reason to believe the public thinks that. Number two, the district attorney decided on the proper course of action. It was our job to investigate the matter and turn the results over to the district attorney's office and that is what we did."

Gibbons admits he knows Giannini.

"I see on the street from time to time. I know him," Gibbons said, who added that familiarity never influenced the outcome of the probe.

Greg Coy: "Did you give any advice or suggestions?"
Gibbons: "No sir."
