HERNANDO, Miss. (FOX13) -

Former Southaven Mayor Greg Davis is scheduled to go on trial Monday, Feb. 24 on charges of embezzlement, but where that trial will take place is still up in the air.

Attorney Steve Farese has asked for a change of venue because of the extensive media coverage of the former mayor's other cases.

We won't know where the trial will take place for sure until Monday during the jury panel. It depends according to the judge on how the questioning of jurors goes. If the judge feels there can be a fair trial here, it will be here. If not it will take [;ace anywhere in Mississippi.

Farese argued Thursday that the former mayor's embezzlement case should be tried elsewhere and that media saturation of Davis' traffic court case, his divorce proceedings and State Auditor's civil suit would prevent his client from getting a fair trial in DeSoto County.

"Well, that is my opinion but my opinion does not rule the day," Farese said. "That is up to the judge. He put the requisite amount of time and thought into it and made the decision. That is how the process works."

District Attorney John Champion said a fair trial in DeSoto County was very possible, and he argued at one point that much of the media attention was brought on by Davis himself.

"The only comment I made was the fact that these media reports, a lot of them, were in his office," Champion said. "It wasn't just the media putting information out there."

"I think the judge answered that question," Farese said. "I mean, at some point, you get to the point where you get tired of being the pinata and you want to get your story out there. I think the court recognized that."

At this point the case could be tried in DeSoto County and that all depends on Monday. But if not here, where?

"Obviously first consideration is who has space available for us and a similar makeup as our county, so that

could be from here to the Gulf Coast," Champion said.

Jury selection begins on Monday at 9 a.m. in DeSoto County Circuit Court in Hernando. At the end of the day Monday we should know exactly where this case will be tried.
 
Farese said the late filing for a change of venue came because a resolution could not be reached in the case.
