Wrongful death lawsuit filed against Javaris Crittenton

Former NBA and Georgia Tech star Javaris Crittenton is now facing a wrong death lawsuit in addition to murder and drug charges.

Crittenton was arrested on charges Wednesday while out on bond for allegedly murdering Julian Jones,  a mother of four, in August 2011.

Jones' mother, June Woods, filed the wrongful lawsuit Thursday. Roger Orlando, Woods' attorney, said they filed the lawsuit at this time so that legal papers could be served on Crittenton while he is at the Fulton County Jail.  

The wrongful death lawsuit accuses Crittenton of gross negligence and intentional conduct that caused the death of Jones.

"It's been hard. Sometimes you have crying, sometimes you have kids asking for their mom," Woods said.

The six page lawsuit calls for punitive damages without specifying a dollar amount.

Crittenton waived a court appearance on drug charges Thursday. His attorney, Brian Steel, who is also representing him in the murder trial, maintained his innocence.

"He's absolutely not guilty. We're going to have a trial. We're not going to have some mob justice," said Steel.

Orlando says the burden of proof in a civil wrongful death lawsuit is on a lower standard than a criminal trial. As an example, Orlando pointed out the O.J. Simpson case.  Even though Simpson was acquitted of murdering his wife and her friend, a jury found him culpable in the wrongful death lawsuit against him.
