Photographer sued over topless Empire State Building shots

A professional fashion photographer has been sued for taking topless pictures on the observation deck of the Empire State Building.

The owners of the New York City landmark filed a $1.1 million lawsuit against Allen Henson for a set of nude photos he took in August.

According court papers, Henson didn't apply for permission and never notified the building about his plans for the photo shoot. Building representatives called it objectionable and inappropriate because the observation deck is a family and tourist attraction.

Henson says the view from atop the building is so breathtaking he didn't think anyone noticed.

"It's very interesting to say the least. It wasn't really premeditated. I've done a couple of these before. A couple of minutes later they call and say that you're being sued for $1.1M. It seems a bit random," said Hanson on the FOX 5 News morning program Good Day NY.

He also says that he hasn't used the images commercially as the suit claims.
