PANOLA COUNTY, Miss. (FOX13) -

Panola County Sheriff Dennis Darby is being sued in federal court by the Police Chief of Como, Miss.,  and the assistant chief.

Sheriff Darby said the lawsuit is personal and that Como POlice Chief Earl Burdette and Assistant Chief Fay Pettis used to be employees of his department but now work elsewhere for a reason.

In the federal lawsuit Chief Burdette claims that on the night of Nov. 14, 2013, he was taking a witness to the police department from a shooting scene when the sheriff's department forced their way into the police department, beat up the chief, and then slammed the assistant chief against a wall when she tried to stop them.

Sheriff Darby said the Como police chief and his assistant are lying and that the truth will come out in court, and that Burdette and Pettis will perjure themselves on the stand from what he has read of the lawsuit. .

"Well, I know they absolutely have to," Sheriff Darby said. "Reading it, they put it on paper, we've got evidence. We hope the judge whoever that may be will invoke the perjury law because we are confident when you are honest and dependable and you tell the truth, you will be cleared of charges or accusations that are made."

"This is personal, and it's uncalled for."

The lawsuit accuses the sheriff and the deputies involved of inflicting emotional distress, physical harm and of unlawfully detaining Chief Burdette and Assistant Chief Pettis. Sheriff Darby accuses Burdette and Pettis of interfering with an investigation and of removing a witness from a scene where they had no jurisdiction.

"This is history with him," Sheriff Darby said. "He has never gotten along with anybody, never gotten along with any other department. He has been a problem as far back as I know and she has, too. This has come to a head and this has come to the wrong people to deal with."

FOX13 News contacted both Chief Burdette and Assistant Chief Pettis for comment on the lawsuit, but both declined comment.
