Firearm retailers have hopes set on Chicago

Some firearms dealers near Chicago contemplated new business opportunities Tuesday following a federal judge's ruling declaring the city's ban on gun sales unconstitutional.

Tony Kole from Norridge, was one of them.

Back in Dec. Tony Kole won his battle on gun retailers when the village of Norridge voted Dec. 11 to back off an earlier total ban on firearm sales.

But he may have lost the war.

Norridge's new rules will force Kole to move his small Internet and mail order-business out of its current office, because it's less than 1,000 feet from Northridge High School.

So, when the Federal court ruling that could clear the way for gun shops to open in Chicago was announced, it was big news for Kole, who lives on the city's North Side.

"I was ecstatic. I'd like to open a gun shop in Chicago, because there's an untapped market of law-abiding citizens that have been forced to go out to the suburbs to purchase handguns and rifles for lawful purposes," Kole said.

Monday's court ruling gave city hall a week to decide whether to appeal the judge's decision that Chicago's current total ban on retail gun sales violates the U.S. Constitution.

The city could follow the example of Northwest suburban Norridge.

Confronted by a lawsuit from Kole and his lawyer, Norridge last month allowed gun retailers, but only in areas with specific zoning located away from schools, parks and churches. Some second amendment activists said Chicago should not treat gun shops differently from any other retailer.

David Sigale, a gun rights lawyer, commented on the issue saying "I think it's a bad idea. I think we've seen from other cases and other experts and reports and what not that a gun store fits within a regular commercial area. It's a commercial business.

Kole, whose favorite handgun is a Sig Sauer .45 caliber, said he hopes gun shops will be allowed downtown.

If so, he definitely plans to open shop right in the loop.
