Fatal Crash: Fallen DPS officer's family sues truck driver

YUMA, Ariz. -

It was a horrific video to watch -- a truck driver crashed into a DPS patrol car, killing Officer Timothy Huffman in May.

This happened in Yuma and investigators say the driver was on his cell phone looking at provocative pictures of women on Facebook.

I talked with Officer Huffman's brother and the attorney for the family.  They have filed a lawsuit against the driver.

"How is it that a driver of a commercial motor vehicle, especially a gas tanker, allowed to be on a phone surfing the internet?  It's mind boggling," said Huffman family attorney Michael Leizerman.

Leizerman says the camera from inside the truck pointed at the driver was intentionally blocked by the driver's wallet.  It suggests the driver was hiding his cell phone use.

"So you can't see the driver and then after impact, in watching the video and according to police analysis, the wallet is dislodged off and then we see a cell phone flying from the driver's hands."

Huffman's brother, Paul, who is an Immigration Customs Enforcement agent, calls this a senseless tragedy.

"I believe the public is aware of using the telephone when you're trying to drive and it should be done or get distracted.. just concentrate on driving so other families don't have to go through the same scenario that we're going through right now as a family."

The driver, Jorge Espinoza, was charged with second degree murder.
