MEMPHIS, Tenn. (FOX13) -

Progress is being made in processing a backlog of more than 7,000 sexual assault kits, kits that have sat untested, some for as long as 40 years.

In October Mayor A C Wharton issued an executive order to the Police Director Toney Armstrong to process the backlogged evidence as soon as possible, no matter the cost.

Shelby County District Attorney General Amy Weirich said with the support of Mayor Wharton and State Sen. Mark Norris (R-Collierville) the situation is improving.

"We've been working the backlog of rape kits for years," DAG Weirich said. "But, being able to take them all in a big giant box and deliver hem to laboratories takes a lot of money and a lot of resources. But, we're in a much better place to get that done than we were a year ago."

Mayor Wharton said he's seeking private and foundation funding to assure all the kits get processed.
