According to the Huffington Post, Massachusetts' highest court will hear arguments on September 4th if the reciting of the Pledge of Allegiance is a violation of the students rights.
The phrase "under God" is what an anonymous atheist group is suing over claiming the "daily recitation of the pledge violates the state's equal rights law".
