Man shot by police after pointing shotgun charged with aggravated assault

The man who was shot and wounded by police after he allegedly pointed a sawed-off shotgun at an officer during a traffic stop in the Humboldt Park neighborhood early Sunday has been charged with aggravated assault, among other felonies.

Daniel D. Jackson, Jr., 31, of the 400 block of North Central Park Avenue, has been charged with one felony count each of unlawful use of a weapon, aggravated assault of a police officer with a firearm and possession of a controlled substance, police said. He was also charged with one misdemeanor count of aggravated assault with a deadly weapon and two counts of resisting an officer.

The incident began about 4:30 a.m. in the 3600 block of West Franklin Boulevard, Independent Police Review Authority spokesman Larry Merrit said, confirming police shot and wounded a person during the confrontation.

Officers were responding to a call of shots fired in the area, according to a statement from police News Affairs.

Upon arrival, officers were flagged down by a female who said a male pointed a large caliber gun at her, according to the statement. She then pointed to a vehicle traveling north on Central Park Avenue as the vehicle the male was seen driving earlier.

Officers activated their "emergency equipment" and curbed the vehicle, the statement said.

According to Fraternal Order of Police spokesman Pat Camden, the officers pulled the vehicle over south of Chicago Avenue on Central Park Avenue, Camden said.

Police told the man to raise his hands, the statement said.

The driver was hunched over and refused to show his hands, Camden said.

When an officer on the passenger side of the car shined a flashlight at the man, he allegedly sat up, revealing a sawed-off shotgun pointed at the officer, Camden said.

The officer fired twice in self-defense, but the driver drove away, Camden said.

The driver threw a weapon from the window of his vehicle near the 900 block of North Central Park Avenue, the statement said.

The vehicle struck an elevation in the roadway near Potomac and Central Park avenues where the vehicle landed near a viaduct, the statement said.

A tire on the vehicle blew out, Camden said.

Police arrested the driver and took him into custody at the Harrison District Police station, where they later discovered that the officer's gunfire struck the man, according to both Merrit and Camden.

Jackson was taken to John H. Stroger Jr. Hospital of Cook County, police said.

The shotgun was recovered and narcotices were discovered on Jackson, police said.

No officers were injured. Area detectives and the IPRA are investigating.

Jackson is scheduled to appear in bond court on Monday.
