Cell video shows possible MPD excessive force

Exclusive video captured on a cell phone by a bystander shows the moments after an alleged shoplifter fought with Memphis police Wednesday evening.

The video clip appears to be after the unidentified man was shot by a police officer, which happened after police say an off-duty officer spotted a man shoplifting at the Walmart on Austin Peay in Raleigh.

This exclusive cellphone video obtained by FOX13 News appears to show a Memphis police officer using excessive force on the shoplifting suspect. The officer first appears to stomp on the suspect, then shortly after  kicks him twice.

"Looking at it from this it appears to be inappropriate," said Police Director Toney Armstrong, who viewed the video for the first time Thursday afternoon.

Director Armstrong said he hopes to include these clips into their investigation of the scuffle between the alleged shoplifter and police in the store's parking lot. He says the officer-involved shooting happened after an irate suspect refused commands, assaulted an officer, then fought with a few officers.

"According to officers, he reached into his waistband, made overt movement toward them and one of them used their service weapon to shoot him," the police director said.

But Director Armstrong says no weapon was found on the suspect. While the officer who fired the round is relieved of duty with pay, Armstrong says disciplinary action could be taken for those involved recorded in the cellphone video.

"It can go anywhere from oral reprimand, all the way to termination," he said. "Looking at it from a perspective that I'm looking at it and appears to be (inappropriate). But again, it had to be some action before it. Without seeing the complete video, I don't want to make an assumption."

Police have not released the names of the three officers involved in the incident.  This case marks at least the fifth officer-involved shooting this year.  

"Apparently this one escalated to the level where it became physical and during that physical altercation they felt their lives were in danger," Director Armstrong said.

Two officers suffered minor injuries in the scuffle with the alleged unidentified shoplifter.

The man who was shot remains in critical condition at The MED.

Armstrong says he plans to look into Walmart's surveillance video.
