DETROIT (WJBK) -

She put her house on the line, but Carolyn Cheeks Kilpatrick didn't want to talk about it.

Her son, Kwame Kilpatrick, wants to go home. His attorney, Jim Thomas, filed a motion in federal court requesting a hearing.

The former mayor is asking the judge to release him on bond so he can go home to Texas to spend time with his wife, Carlita, and his three sons while he waits to be sentenced, which is expected to happen in about four months.

Kilpatrick was convicted last week on 24 counts, including racketeering, bribery and extortion, and in his state case, the former mayor violated his parole, lied about his assets and ignored court orders.

However, in the motion filed Monday, his attorney claims he is not a danger to society and not a flight risk, that Kilpatrick already surrendered his passport, and he doesn't have any money to go anywhere because any money he did have went towards restitution.

To strengthen his position, his mother is willing to put her La Salle house up as collateral, estimated online to be worth around $100,000.

The judge just said no to a bond.  Our legal analyst Charlie Langton said the judge will likely grant a hearing, but will she change her mind and will the house going up as collateral make a difference?  Langton said probably not.
