LANSING, Mich. (WJBK) -- Michigan Supreme Court Justice Diane Hathaway has unexpectedly announced her retirement as her reputation smothers under the glass of legal suspicion.
Her announcement comes as the state Judicial Tenure Commission filed a formal complaint saying that Hathaway should be suspended immediately amid allegations of bank fraud.
The commission said that Hathaway and her husband, Michael Kingsley, allegedly negotiated a short sale of their Grosse Pointe Park home with a bank without disclosing they had transferred the ownership of their Florida home to a relative. That Florida house was later put back in their name.
Hathaway and her husband have denied any criminal wrongdoing. Her retirement will take effect January 21. Governor Snyder will appoint Hathaway's replacement, tipping the balance of the Supreme Court to five Republicans and two Democrats.
This isn't the end of Hathaway's troubles because the U.S. attorney is suing her in federal court claiming she kept the Florida house by committing bank fraud and should therefore forfeit the three quarters of a million dollar home.
