MEMPHIS, Tenn. - Wednesday afternoon, Scotty Harris said he got yet another excuse from a man who owes him big money.
Harris said not even a house call to the million dollar home John Fisher is living in, in Memphis, proved to work when getting Fisher to finally pay up.
"It's fraud. I mean would you go out to eat dinner at a nice restaurant and walk out without paying? It's a criminal offense. Why he's not sitting down at 201 Poplar, is beyond me."
Harris said his trouble with Fisher, seen here in an arrest photo from an old theft of services charge from 2008, started 6 weeks ago. That's when he said Fisher's check to his pool company, "Aqua Construction International," bounced.
"The check is no good. I still have a $42,000 check that's no good, plus services rendered. Somebody needs to pay me, or take him to jail, or both."
Harris said behind the house on Oak Knoll Cove, there's a pool which he already performed $4500 in repairs on. He said the other $38,000 dollars Fisher owes him, is for future work Fisher requested be done, and even signed a contract committing to. Harris said he'd already spent $6,700 dollars buying the supplies to do the job, when Fisher wrote the bad check. Harris has now filed a police report against Fisher.
This isn't the first time a small business like "Aqua Constraction" has gone to police over a hot check from Fisher. Court records show a lawn service in Eads, TN filed charges over a returned check for $2,300.
However according to criminal court documents, last year, that case and half a dozen other theft charges against Fisher, were dismissed. The Shelby County District Attorney General's Office said based on the evidence, and talks with the victims, it was the appropriate action to take.
Fisher wouldn't take Fox 13's questions about Harris' case or the others. But we've confirmed Memphis Police are actively investigating. Meantime, Harris suspects he's been given just another broken promise to be paid.
"He said come back Friday. All my expenses I've incurred to date, plus what he owes me, he would reimburse me in cash. So here we go again."
