Primary Election Probe Underway

MEMPHIS, Tenn. - Shelby County is one step closer to having answers about what went wrong at the polls during the August 5 election. Chancellor Walter Evans assigned a supervisor for the investigation but some are asking with just four days until the election is certified, is that enough time?

Voters believe their votes weren't counted. On the other side the problem is being blown out of proportion.

Inside Chancellor Walter Evans Chancery courtroom lawyers from both sides line the courtroom in hopes of resolution into what some are calling injustice on Election Day.

"Basically the court has appointed clerk and Master Duane Settle to hear the on going issues that we're having," said Van Turner, attorney for the plaintiff.

But attorney for the plaintive Regina Morrison Newman said there's much more here than just problems. There are also allegations of hiding information.

"The entire incident reports of people calling and saying I have this problem at the polls it's a trouble log there's a list of resolutions that some of the info has been redacted," said Morrison.

Shelby County Election Commission Chairman Bill Giannini was unable to talk about the ongoing investigation but said the commission took action.

"I know that the truth will come out there will be an opportunity to talk about what did happen and corrective actions that we've taken to address what's happened," said Giannini.

Still waiting on the certified election results, attorney for the plaintiff's Van Turner said things are moving forward. The investigation will continue and at the heart of the investigation were the electronic ballot machines.

"We just continue the inspection we did that Thursday we did that Friday we'll be back this afternoon continuing the inspection," said Turner.

But some say there was faulty software in the machines to begin with and that the voting process and the subsequent election may have been compromised and people's votes not counted.

"The election commission seeks to certify the votes this Thursday well make a decision prior to then whether or not we would ask formerly ask that they not certify," said Turner.

While the TBI is investigating this case, after Thursday, the plaintiff's will still have 5 days to contest the election and seek federal help.
