MEMPHIS, Tenn. - The Memphis City Council also voted in committee, on a resolution that would put the Memphis City Schools funding issue in front of the voters.

The City Of Memphis and MCS are locked in a lawsuit that is now in the court of appeals.

In 2008, the city took away school funding, because the council said it wasn't responsible for the funding.

The school district argues the move violated state law. So far, lower courts have sided with the schools.

Council chairman, Harold Collins wants to see, what the citizens want to do.

"If they tell us yes, they know, the citizens will know, that they can expect a tax increase going forward to fund Memphis City Schools," said Collins.

Collins said if it passes, he would consider with drawing the lawsuit from the appeals court.

The exact language that will appear on the November ballot is still being worked out.
